Kullanım Şartları

1. Taraflar ve kapsam
Bu şartlar, Anında Yazılım (Anındahizmet / Barış Medya; işleten: Barış Kandemir) tarafından anindayazilim.com.tr adresinden sunulan sahte tıklama koruma ve reklam raporlama platformunun ("Hizmet") kullanımını düzenler. Hizmeti kullanan reklamveren ("Müşteri"), bu şartları kabul etmiş sayılır. Ücretli paketlere ilişkin ticari koşullar, ayrıca kararlaştırılan hizmet sözleşmesi veya paket kapsamında belirlenir.
2. Hizmetin tanımı
Hizmet; Müşterinin web sitesine yerleştirilen bir takip kodu ile Google Ads reklamlarından gelen ziyaretleri analiz eder, geçersiz tıklama şüphesi taşıyan IP adreslerini web sitesinde engeller, bu adresleri Müşterinin Google Ads kampanyasına "IP hariç tutma" olarak ekler ve kampanya performansını raporlar. Ek olarak kampanya zamanlama, saldırı durumunda geçici durdurma ve istek üzerine teklif stratejisi sıfırlama gibi araçlar sunar.
3. Hesap ve güvenlik
- Müşteri, hesap bilgilerinin doğruluğundan ve kullanıcı adı ile şifresinin gizliliğinden sorumludur; bu bilgileri üçüncü kişilerle paylaşmamalıdır.
- Her Müşteri hesabı, bizim tarafımızdan tanımlanan bir Google Ads hesabı ve kampanyasıyla eşleştirilir; Müşteri yalnızca kendi verisini görür.
- Hesabında yetkisiz kullanım şüphesi olan Müşteri bizi derhal bilgilendirmelidir.
4. Google Ads yetkilendirmesi
Müşteri, Hizmetin sunulması için Anında Yazılım'ın, Müşterinin Google Ads hesabının yöneticisi sıfatıyla, yalnızca atanan kampanya üzerinde şu işlemleri yapmasına izin verir: IP hariç tutma ekleme/kaldırma, kampanyayı durdurma/yeniden başlatma (saldırı kalkanı, zamanlama veya Müşterinin talebi), Müşteri talep ettiğinde teklif stratejisini geçici olarak sıfırlama ve performans verilerini okuma. Hizmet; kampanya oluşturma, bütçe, hedefleme, reklam metni veya faturalandırma ayarlarını değiştirmez. Hesabın sahipliği ve kontrolü Müşteride kalır.
5. Takip kodu ve ziyaretçi bilgilendirmesi
Müşteri, takip kodunu kendi web sitesine yerleştirmekten ve ziyaretçilerine yürürlükteki mevzuata (KVKK, GDPR vb.) uygun bilgilendirme yapmaktan sorumludur. Ziyaretçi verileri bakımından Müşteri veri sorumlusu, Anında Yazılım veri işleyendir; ayrıntılar Gizlilik Politikası'nda yer alır.
6. Korumanın niteliği ve sınırları
- Tespit otomatik kurallara dayanır. Hizmet, her geçersiz tıklamanın engelleneceğini veya her reklam bütçesi kaybının önleneceğini garanti etmez.
- Yanlış pozitif olabilir; meşru bir ziyaretçi engellenebilir. Müşteri, panelden bir IP adresinin engelini kaldırabilir.
- Geçersiz tıklama kredileri ve iadeler Google tarafından belirlenir; Hizmet bu konuda sonuç taahhüdü vermez.
- Web sitesi engellemesi Google Ads'ten bağımsız çalışır. Google Ads API limitleri veya Google tarafındaki kesintiler, Google Ads'e IP eklenmesini geciktirebilir.
7. Teknik kayıt raporları
Hizmetin ürettiği IP teknik kayıt raporları bilgilendirme amaçlı sistem kayıt özetleridir; hukuki görüş veya kesin delil niteliği taşımaz. Bir IP adresi tek başına bir kişinin kimliğini belirlemez. Raporların hukuki süreçlerde kullanımı ve kişisel verilerin korunması mevzuatına uygunluğu Müşterinin sorumluluğundadır; hukuki değerlendirme için bir avukata danışılmalıdır.
8. Kabul edilebilir kullanım
- Hizmet, hukuka aykırı, yanıltıcı veya üçüncü kişilerin haklarını ihlal eden amaçlarla kullanılamaz.
- Hizmetin güvenliğini veya işleyişini bozacak girişimler (yetkisiz erişim, aşırı yükleme, tersine mühendislik) yasaktır.
- Müşteri hesabı başkasına devredilemez.
9. Paketler, ödeme ve süre sonu
Hizmet, Müşteri ile kararlaştırılan paket ve süre boyunca verilir. Paket süresi dolduğunda veya Müşteri hesabı aktif olmadığında koruma ve ilgili özellikler durdurulur; kayıtlar saklama süreleri uyarınca korunur.
10. Hizmet sürekliliği
Hizmeti kesintisiz ve hatasız sunmak için makul çabayı gösteririz ancak bakım, üçüncü taraf hizmet kesintileri veya Google Ads API sınırları nedeniyle gecikme ve kesintiler olabilir.
11. Fikri mülkiyet
Platformun yazılımı, arayüzü, markası ve içerikleri Anında Yazılım'a aittir. Müşteri, hizmet süresince yalnızca kendi iş amaçlarıyla kullanım hakkı kazanır.
12. Sorumluluğun sınırlandırılması
Kanunun izin verdiği ölçüde; Anında Yazılım dolaylı zararlardan, kâr kaybından, Google'ın politika veya sistem kararlarından kaynaklanan kayıplardan sorumlu değildir. Kasıt ve ağır kusur hâllerindeki sorumluluk, kanunen sınırlandırılamaz.
13. Fesih
Taraflar, hizmet sözleşmesi hükümlerine uygun olarak hizmeti sonlandırabilir. Şartların ihlali hâlinde hesabı askıya alma veya kapatma hakkımız saklıdır.
14. Değişiklikler
Bu şartları güncelleyebiliriz. Güncel sürüm bu sayfada yayınlanır; Hizmeti kullanmaya devam etmek güncel şartların kabulü anlamına gelir.
15. Uygulanacak hukuk ve iletişim
Bu şartlara Türkiye Cumhuriyeti hukuku uygulanır; uyuşmazlıklarda Türk mahkemeleri ve icra daireleri yetkilidir.

Terms of Service

1. Parties and scope
These terms govern the use of the invalid-click protection and ad reporting platform (the "Service") provided by Anında Yazılım (Anındahizmet / Barış Medya; operated by Barış Kandemir) at anindayazilim.com.tr. An advertiser using the Service (the "Client") accepts these terms. Commercial conditions for paid packages are set out in the separately agreed service agreement or package.
2. Description of the Service
Using a tracking script placed on the Client's website, the Service analyses visits arriving from Google Ads, blocks IP addresses suspected of invalid clicking on the website, adds those addresses to the Client's Google Ads campaign as IP exclusions, and reports campaign performance. It also offers campaign scheduling, temporary pausing during an attack, and a bidding-strategy reset on request.
3. Account and security
- The Client is responsible for the accuracy of its account information and for keeping its username and password confidential, and must not share them with third parties.
- Each Client account is linked to a Google Ads account and campaign that we assign; a Client sees only its own data.
- A Client who suspects unauthorised use of its account must notify us immediately.
4. Google Ads authorisation
To deliver the Service, the Client authorises Anında Yazılım, acting as manager of the Client's Google Ads account, to perform the following only on the assigned campaign: add and remove IP exclusions, pause and resume the campaign (attack shield, schedule or Client request), temporarily reset the bidding strategy when the Client requests it, and read performance data. The Service does not create campaigns or change budgets, targeting, ad text or billing settings. Ownership and control of the account remain with the Client.
5. Tracking script and visitor notice
The Client is responsible for placing the tracking script on its own website and for informing its visitors as required by applicable law (the Turkish Data Protection Law, GDPR, etc.). For visitor data, the Client is the data controller and Anında Yazılım is the data processor; details are in the Privacy Policy.
6. Nature and limits of protection
- Detection is based on automated rules. The Service does not guarantee that every invalid click will be blocked or that every loss of ad budget will be prevented.
- False positives are possible; a legitimate visitor may be blocked. The Client can unblock an IP address in the dashboard.
- Invalid-click credits and refunds are determined by Google; the Service gives no commitment about them.
- Website blocking works independently of Google Ads. Google Ads API limits or outages on Google's side may delay the addition of IP exclusions to Google Ads.
7. Technical record reports
IP technical record reports generated by the Service are informational system-record summaries; they are not legal advice or conclusive evidence. An IP address alone does not identify a person. The Client is responsible for using the reports lawfully and in compliance with data protection law, and should consult a lawyer for legal assessment.
8. Acceptable use
- The Service must not be used for unlawful or misleading purposes or in a way that infringes third-party rights.
- Attempts to compromise the security or operation of the Service (unauthorised access, overloading, reverse engineering) are prohibited.
- A Client account may not be transferred to another party.
9. Packages, payment and expiry
The Service is provided for the package and period agreed with the Client. When the package expires or the Client account is not active, protection and related features are stopped; records are kept in line with the retention periods.
10. Availability
We make reasonable efforts to provide the Service without interruption or error, but delays and interruptions may occur because of maintenance, third-party outages or Google Ads API limits.
11. Intellectual property
The platform's software, interface, brand and content belong to Anında Yazılım. The Client receives a right to use the Service for its own business purposes during the term of the service.
12. Limitation of liability
To the extent permitted by law, Anında Yazılım is not liable for indirect damages, lost profits, or losses arising from Google's policy or system decisions. Liability for intent or gross negligence cannot be limited by law.
13. Termination
Either party may end the service in accordance with the service agreement. We may suspend or close an account in case of breach of these terms.
14. Changes
We may update these terms. The current version is published on this page; continuing to use the Service means acceptance of the current terms.
15. Governing law and contact
These terms are governed by the laws of the Republic of Türkiye; Turkish courts and enforcement offices have jurisdiction over disputes.
